DMVR Terms & Conditions

DMVR does not extend reservations to group rentals, (non-family), that have guests under the age of 25. Nor, do we accept reservations for prom weekends or senior week. This policy is strictly enforced

By making payment guests hereby acknowledge they are legally bound by the Vacation Rental Agreement. This Vacation Rental Agreement (the “Agreement”) is made between Don Martin Vacation Rentals (“DMVR”), in its capacity as a transaction broker, and the renter specified in the Rental Reservation Confirmation listed above (“Tenant”) and is effective as of date of payment. This Agreement sets forth the terms for the short-term rental of the property located at the address listed in the Rental Reservation Confirmation. For the purpose of the terms of this Agreement, Tenant is defined as “you, or yours”.

PAYMENT/FEES: A 50% deposit must be paid at the time of booking for your reservation to be considered finalized unless other payment arrangements have been made in writing. All rental balances must be paid 30 days prior to arrival date unless other payment arrangements have been made in writing. Payments may be made via check or credit card; DMVR accepts Visa, MasterCard and Discover.

ADMINISTRATION FEE: An administration fee is applied to all DMVR reservations in addition to any rental amountsor security deposits to cover expenses including but not limited to processing, bookkeeping, mailing charges, phone charges and other miscellaneous expenditures. Please note: The fee amounts shown in the Reservation Confirmation reflect the actual charges Don Martin Vacation Rentals collect.

CANCELLATION POLICY: Cancellations more than 60 days prior to original check-in date are fully refundable minus a $150.00 Cancellation fee. CANCELLATIONS 60 DAYS OR LESS PRIOR TO CHECK-IN DATE ARE 100% NONREFUNDABLE. Following a cancellation, if DMVR is successful in re-renting the property for all or part of the time period booked you will be refunded to the extent that the property owner and DMVR sustain no loss on the rerental. In such an event a $150.00 cancellation fee will apply. You will be given the option to reschedule your reservation or be refunded in full should any County, State or Federal Emergency be declared for the duration of your booking that expressly prohibits the rental of the property to you or your occupancy of the property. Refunds will not be issued due to events being cancelled or rescheduled, nor for tourist attractions being closed or at limited capacity.

TRIP CANCELLATION INSURANCE: DMVR strongly recommends that you purchase trip cancellation insurance. You may purchase this insurance independently or speak with a DMVR representative for more information on how to purchase a policy.

VACATION RENTAL AGREEMENT & IDENTIFICATION: A rental agreement must be filled out, signed and returned immediately upon receipt. You may return this agreement to DMVR via fax to (609) 522-7755, or email to rentals@donmartinvacationrentals.com, or by regular mail to 421 W Spruce Ave North Wildwood, NJ 08260. You may also deliver the required documents in person to our office. DMVR also requires a copy of your valid driver's license or other government issued photo ID, and a valid credit card to be on file prior to check-in.

CHECK-IN: Check-in time is 4:00 PM EST. Check-in instructions will be provided via email or text message 48 hours prior to your arrival date. Some DMVR properties offer check-in directly at the home and other properties require tenant to pick up keys at our office. No early check-ins will be permitted, except in special circumstances. No check-ins will be allowed until payment has been made in full with a credit card on file AND this Agreement has been completed, signed and returned to DMVR with a copy of your photo ID. If your check-in instructions require keys to be picked up at our office and you plan to check-in later than 5:00 PM, you must contact DMVR in advanceso that special arrangements can be made. Please do not park at or enter the premises prior to the 4pm check-in time unless otherwise instructed by our office. If you enter the property prior to 4pm, and the rental property has not been cleaned and/or inspected, our cleaning crew will not enter, and you will take possession “as is”. You will not be entitled to any reimbursement for cleaning. Parking at the rental property prior to your check-in time may result in your vehicle getting towed as our cleaning & maintenance teams must have parking access while services are being rendered.

CHECK-OUT: Check-out time is no later than 10:00 AM. Depending on the property, keys are either left inside the lockbox at the property or returned to our office. You will be given written instructions the day before your departure date on how to return keys, parking permits and/or pool passes. No late check-outs will be permitted. You must have all personal property removed, have vacated the premises and have your vehicle(s) off the property by 10:00 AM to avoid additional fees assessed against your security or charged against your credit card on file. Return all keys and parking permits as instructed. If you will be departing earlier than 10:00am EST, we ask that you please notify us via email to rentals@donmartinvacationrentals.com, so that we can schedule our cleaners at an earlier time. SECURITY DEPOSIT/PROPERTY DAMAGE: Tenants are held liable, to the full extent, for any damage and/or loss incurred as a result of their stay. DMVR offers two options to Tenants to protect against damage to the premises: a non-refundable damage waiver, which is a one-time fee of $70.00; or, a refundable security deposit of in the form of a $500 hold. Additionally, DMVR requires Tenant to place a copy of a valid debit or credit card on file. If warranted, you agree that DMVR may place incidental charges against your credit card as may be applicable for reasons contained herein. The non-refundable damage waiver covers accidental damage ONLY, up to $1,000 provided such damage is disclosed to DMVR prior to check-out. The non-refundable damage waiver does not cover intentional damage, theft, excessive cleaning, negligence, flea infestation caused by a pet, or loss of rental revenue as a result of the property being held off market during remediation of damages caused by Tenant. Damage not reported to DMVR will not be covered and Tenant will be liable for all costs associated with unreported damage. Intentional damage will not be covered by these fees and Tenant will be liable for all costs associated with intentional damage. Tenant fully accepts responsibility for any/all damage caused to the property by any act or omission of the Tenant. Any damages that are not covered or exceed the $1,000 limit under the non-refundable damage waiver will be charged to the credit card on file. If Tenant selected to pay for a Security Deposit, you will be responsible to cover any intentional or unintentional damages to the rented property interior or exterior that occurs during your stay. Tenant will be responsible for any damage to real or personal property as a result of inadvertent acts or omissions. Your security deposit may also be used to cover any intentional damage, theft, excessive cleaning, unintentional and incidental damage or flea infestation caused by a pet. If you choose a security deposit, the cost of any damage to the property, and any related labor to replace and deliver back to the property will be withheld from your security deposit. Any damages that exceed the $500.00 security deposit will be charged to the credit card on file. Should any damage come to light after the Tenant has departed, Tenant agrees and acknowledges that DMVR may charge to the Tenant’s credit card or send an invoice for the amount to the registered address. DMVR will, however, try to rectify any damage internally prior to contracting specialists to make the repairs, thereby attempting to make an effort to keep any costs that the Tenant would incur to a minimum. PLEASE NOTE any damage to the rental premises upon your arrival and report it immediately to our office to avoid possible liability.Security deposits are refunded according to your method of payment, within 30 days of check-out and no charges will be made against the credit card held on file provided the following criteria has been met:

-No accidental damage or loss has occurred to the house or contents, beyond normal wear and tear

-All appliances and equipment are left in good working order

-Trash and recyclables are properly separated and disposed of in the proper containers, put out for collection on the proper days and in accordance with instructions provided by DMVR as well as posted in the rental unit

-The grill, (if applicable), is left cleaned and the grease trap emptied

-All food is removed from the refrigerator and from the unit

-All dinnerware is washed and stowed in cabinets where found

-The rental premise is generally neat and left in "broom swept" condition and therefore does not require excessive cleaning

-All keys, parking passes and pool passes have been returned as directed

-All GUESTS have vacated the rental premise on time

*THE ABOVE LIST IS NON- EXHAUSTIVE AND DETERMINATION IS AT THE SOLE DISCRETION OF DMVR.

TENANT REPRESENTATION: Tenant represents and warrants that Tenant is at least 25 years old and that Tenant will occupy the Premises during the Term of the tenancy created hereunder. Tenant acknowledges responsibility for the behavior of ALL guests at ALL times while on any of DMVR properties or premises.

FALSIFIED RESERVATIONS: Any reservation obtained under false pretense will be subject to forfeiture of advance payment, deposit, and/or rental money and the party will not be permitted to check-in or evicted.

SUBLETTING/ASSIGNING/OCCUPANCY: There shall be no subletting of the premises. The Tenant shall occupy and use the premises as a vacation rental only and not use the premises for any business, professional, unlawful or hazardous purpose.

USE OF RECREATIONAL EQUIPMENT/ITEMS: Some rental accommodations come equipped with bikes, beach gear, gas grills, fire pits and other equipment for the enjoyment of their guests. Tenants shall use such items properly for their intended use and follow all applicable laws and any rules provided pertaining to the use of such items (i.e., bike helmets and lights). The use of such equipment shall be at the sole risk of the Tenants. Tenant shall assume any and all liability and will hold harmless and defend DMVR, its Affiliates, and the property owner from any and all claims arising from the use of such equipment, inclusive of but, not limited to: death, injury, loss of personal property and damage to property belonging to others arising from use of the rental property and any of its equipment. Tenant is responsible to inspect all equipment prior to use to ensure safe and proper working condition for its intended use. Tenant acknowledges responsibility for the care and on-time return of all equipment. If any of these items are lost, stolen, or irreparably damaged due to neglect; Tenant agrees to pay fair market value for their replacement with the credit card on file with DMVR for incidentals.

USE OF POOL: Should your vacation rental include the use of a pool; it is most likely the pool is not guarded. You may be required to sign a release to utilize the pool. Regardless, children under the age of 14 must be always accompanied by an adult while at the pool. Tenant assumes all liability including, but not limited to, injury and/or death occurring to them, or their invited guests resulting from their use of the pool and agree to hold harmless and defend all others from any such liability.

ACCIDENTS, INJURY OR LOSS: Special risks may be involved when using pool, spas/hot tubs, waterfront properties, decks, porches, stairs, elevators, parking areas, etc. and Tenant assumes all responsibility for himself/herself and their guests and for the consequences of those at risk. DMVR, its affiliates and owners, are not responsible for accidents, injury, death, or loss of personal belongings of any kind. Tenant shall indemnify and hold harmless DMVR from any and against all liabilities, claims, expenses, fees, loss of use of actions of any kind arising out of Tenants or their guests use and occupancy of the premises.

FURNISHINGS & DECOR: Tenant acknowledges that rearranging furniture is not permitted. All properties are privately owned and therefore furnished and decorated at the discretion of the owner. DMVR will not be responsible nor provide a refund to a guest who is dissatisfied with a unit's decor. It is strongly suggested that you review the numerous pictures that are posted or personally preview the premise prior to placing a reservation.

BREAKDOWNS & REPAIRS: Your unit may advertise to have certain equipment and appliances available for your use including televisions, washer/dryer, grill, ice maker, coffee maker, blender, etc... Please report any breakdowns or mechanical failures to our office immediately. We will arrange for repairs to be done as soon as possible. We appreciate your patience and will do everything to minimize inconvenience, replace equipment and expedite repairs; however, NO REPLACEMENT EQUIPMENT CAN BE GUARENTEED FOR ANY MECHANICAL FAILURES INCLUDING AIR CONDITIONING AND/OR SMALL APPLIANCES, NOR WILL REFUNDS BE ISSUED.

AIR CONDITIONING: All DMVR properties offer air conditioning for our guests’ enjoyment and comfort. Tenants may not set the property's Air Conditioners controls/thermostat lower than 65 degrees, as doing so may freeze up the AC unit and could cause permanent damage. If it is determined that an AC unit has frozen up or ceased to function normally as a result of misuse by a guest, fees may be assessed against your security deposit or your credit card on file.

INCLEMENT WEATHER/ACTS OF GOD: In the event of an Act of God such as adverse weather, hurricanes, fire, lightning strikes, or otherwise, DMVR, its affiliates and owners are not responsible for any refunds from monies which have been paid, or for providing lodging elsewhere. No refunds will be issued for inclement weather except in the case of a mandatory evacuation or the property is deemed inhabitable per the sole discretion of DMVR.

LINENS: Bed linens and towels are not included. Tenants must bring their own linens and towels or retain linen rental services from a third party. Your rental agent will gladly refer you to a linen rental service if requested. Pillows, Bedspreads and Mattress Pads are provided.

EQUIPMENT/ITEMS PROVIDED: Properties should be equipped with a broom, dustpan and vacuum for the guest to utilize. Kitchens will be stocked with tableware, kitchenware, cooking utensils, pots & pans, and appliances as advertised. All units have one or more televisions, and some provide beach gear such as chairs. In the event that an item advertised as supplied is missing or broken, DMVR will work to arrange for repair/replacement of said item, however, no guarantee is made that missing item(s) will be replaced nor will refunds be issued. Tenants must provide their own trash bags, cleaning supplies, toiletries, paper products and other consumable items.

MEDIA SERVICES PROVIDED: All DMVR rental properties provide television and Internet media services unless otherwise disclosed. These services may include one or multiple televisions with Cable, Satellite and/or Internet Streaming Media and include Wi-Fi services. In the event that any of these services fail to function properly, DMVR will work to facilitate the repair and restoration of these services as soon as possible. No guarantee can be made that the media services advertised to be provided will be functioning properly, nor will any refunds be issued for any failure of any media services advertised to be provided.

SPECIFIC PERFORMANCE & REPLACEMENT RENTAL PROPERTIES: DMVR is acting as a transaction broker only and represents neither the property owner nor the Tenant and cannot guarantee specific performance of any Vacation Rental Agreement. DMVR also reserves the right to offer Tenant a different unit in the event the reserved unit is unavailable due to unforeseen circumstances.

CAPACITY, CONDO RULES, QUIET ENJOYMENT: All Tenants and their guests must abide by the Rules and Regulations of DMVR as well as any Rules and Regulations specific to the property they are renting. Each property has a maximum occupancy, which cannot be exceeded. Quiet time will be from 11pm to 7am. Any Tenant, who exceeds their unit's maximum occupancy, disturbs the quiet enjoyment of others and/or is found damaging common elements or property belonging to others, will be removed from the rental premises immediately without refund of payment. Parties of any type are not permitted in properties. Tenant acknowledges that DMVR is not responsible for any objectionable noise or construction at nearby properties

SMOKING: ALL RENTAL PROPERTIES ARE SMOKE FREE. If smoking is detected and/or smoke damage (including vape and/or marijuana) occurs within the home, or if there is any damage from smoking to the home’s exterior spaces, there will be a minimum charge of $500 to the Tenant. Any damaged items will be replaced at fair market value and charged to the Tenant, and/or, if a professional “Ozone Treatment” is required to deodorize the home, the Tenants accepts that they will be charged for these expenses, in addition to the $500 fine. If the home must be made unavailable for rent or an incoming reservation must be relocated because of this, these expenses will also be charged to the Tenant. 

PETS: Some DMVR properties are advertised as pet friendly, however, unless arrangements have been made with DMVR for you to bring your pet to the property, NO PETS OR ANY TYPE OF ANIMALS ARE PERMITTED IN RENTAL UNITS. Be advised, in most cases a pet fee will apply.
